Construction litigation is a complex mixture of science, industry, economics and law with multiple parties and interests asserting conflicting claims in a context of uncertain and ever-changing legal precedent. The overlay and interaction of statutory, contractual, and common law rights and remedies render this area of the law complex and dynamic. Chamberlain ♦ McHaney has substantial experience litigating, at trial and on appeal, construction disputes between and among owners, design professionals, general contractors, subcontractors of various trades in cases involving contract/payment disputes, alleged design/construction defects, and construction site injury and damage. While most of these cases resolve by favorable settlement, the firm has a record of success with the appellate courts too.
