Honor the Subrogation Interest of the Texas Crime Victims Compensation Fund, or else

A crime victim will occasionally bring a claim or suit against a business or premises owner seeking personal injury damages caused by the criminal act of a third party. It is important to keep in mind that crime victims in Texas are eligible for and often receive compensation from the State of Texas Crime Victims Compensation Fund for their medical and other expenses. If the Fund has paid benefits to the victim, it has an absolute statutory right of subrogation in any civil claim or suit that results in a settlement or judgment. Tex. Code Crim. Proc. Ch 56.
Failure to reimburse the Fund, results in personal liability for the defendant, insurer, claims adjuster and defense lawyer. Moreover, you will be imprisoned for six months in jail and fined $500.
Avoid jail and personal liability. Respect the Fund. This ain’t no ordinary subro interest.
