Chamberlain♦McHaney Scores Summary Judgment in Construction Dispute: The firm obtained a summary judgment for its client general contractor in a construction dispute involving conflicting claims between the developer-owner and the contractor. The owner asserted claims for defective and untimely construction and sought damages for remediation and lost profits due to the decline in the real estate market. The contractor claimed substantial completion and sought damages for the balance due under the contract and extra work and materials. To defend against the owner’s claims for affirmative relief, the contractor filed three motions for summary judgment based on failure to comply with TRCCA requirements, TRCCA/RCLA limitations on damages, including lost profits, and TRCCA limitations on warranty claims. The district court granted all three motions, disposing of the owner’s claims against the contractor. Tim Poteet handled the case for the firm.

Ranelle Meroney is starting her fifth fall semester on the faculty of the University of Texas School of Law. As a Lecturer, she works with other experienced trial lawyers in helping law students practice skills learned in the Intensive Trial Skills class, by presiding over mini mock trials. Ranelle is an Advocate of the American Board of Trial Advocates and has tried 93 first chair jury trials in courts of record.

Earlier this month, David Chamberlain was named a 2009 Texas Super Lawyer in Texas Monthly Magazine (limited to 5% of Texas lawyers). This is the fifth straight year he has been selected for the honor.

Twenty-three: That’s how many applicants who have applied for appointment to the Texas Supreme Court seat recently vacated by Justice Scott Brister, who went into private practice. The Guv is not expected to announce his appointment until late November or early December.
